Content
Legal query (istiftā) concerning a land sale transaction between a seller and a representative acting on behalf of the latter’s nephew (khwāhar-zāda). The sale was annulled (iqālat) by mutual agreement, and the representative subsequently repurchased the same land. Later, the seller brought a claim against the buyer, arguing that the purchase was made on behalf of the nephew. The query seeks to determine the validity of the seller’s claim, in view of the fact that the annulment was performed to the satisfaction of both parties. The response, written by ʿUmar b. Muḥammad, concludes that the seller’s claim is invalid.
